Agreeing to these terms
These terms apply when you use the Duluth Concrete Works website, ask us for an estimate, or hire us for concrete work. By doing any of those things, you agree to these terms. If you don't agree, please don't use the site or book work with us.
When you hire us for a job, your written estimate or contract also applies. If that document and these terms disagree, the written estimate or contract for your job controls.
What we do
Duluth Concrete Works is a concrete contractor in Duluth, MN. We build and repair driveways, patios, sidewalks, steps, garage floors, foundations, footings, retaining walls and other concrete work for homes and businesses in Duluth and the cities around it. You can read more about our crew on the About page and see the full list of services from our home page.
Information on this site is general. It describes how concrete work usually goes, not how your job will go. We confirm the details of your job only after we've seen the site in person.
Estimates and pricing
Our estimates are free, done in person, and come with no obligation. An estimate is based on what we can see and measure at your property that day, including the size of the area, the condition of the ground, access for equipment, drainage, and the finish you choose.
Some conditions only show up once the old concrete is out or digging has started, such as soft or wet subgrade, which is the soil the slab sits on, buried debris, roots, or hidden utilities. If we find something that changes the work or the price, we'll stop and explain it to you before going further. Extra work is done only after you approve it.
Unless your written estimate says otherwise, an estimate is good for 30 days. Material prices can change, so an older estimate may need to be updated before we schedule your job.
Scheduling, weather and cancellation
We give you a start date when you book, but concrete depends on the weather. We won't pour in heavy rain, freezing conditions or other weather that would weaken the slab, so we may move your date to protect the work. If that happens, we'll contact you as early as we can and set the next workable date.
Fresh concrete needs time to cure, which is the waiting period while it hardens and gains strength. We'll tell you when it's safe to walk and drive on your new concrete, and you agree to keep people, pets and vehicles off it until then. Damage from early use is not covered by our work guarantee.
If you need to cancel or reschedule, please call us as soon as you can. If we've already ordered materials, scheduled delivery or started work, you may be responsible for those costs, as stated in your written estimate or contract.
Your responsibilities as the property owner
You agree to give our crew safe access to the work area and to tell us about anything we should know, such as sprinkler lines, septic systems, buried wiring, or disputes over property lines. You are responsible for knowing where your property lines are.
Permit and inspection requirements depend on the job and on the city where your property sits. If your job needs a permit, we'll talk through who handles it before work begins.
Payment terms
The amount you owe, any deposit, and when the balance is due are written in your estimate or contract. Unless that document says otherwise, the balance is due when the work is complete.
If a payment is late, we may pause any remaining work until it's paid. You are responsible for reasonable costs we incur to collect an unpaid balance, as allowed by law. Under Minnesota law, a contractor who isn't paid may have the right to file a lien against the property where the work was done.
Our guarantee and what concrete does naturally
Duluth Concrete Works is licensed and insured, and we stand behind our work. If something about the job isn't right, call us and we'll work with you to make it right.
Concrete is a natural material, and some things are normal and not defects. Small hairline cracks can happen even on a well-built slab, which is why we cut control joints, the planned grooves that give the slab a place to crack in a straight line. Color and texture can vary from one pour to the next, and colored or stamped concrete won't match a sample exactly.
Our guarantee does not cover damage from frost heave or ground movement beyond our control, deicing salts or chemicals, heavy vehicles or equipment the slab wasn't built for, changes to drainage after we finish, early use before curing is done, or lack of the care we recommend, such as sealing.
Apart from any guarantee written in your contract, our work and this website are provided as is, and we make no other warranties, express or implied, to the extent the law allows.
Limits on our liability
To the extent the law allows, Duluth Concrete Works is not liable for indirect, incidental or consequential damages, such as lost use of your driveway, lost income, or damage to landscaping and lawn that is a normal part of the work. Our total liability for any job will not exceed the amount you paid us for that job.
We are not responsible for damage to buried utilities, pipes or wiring that were not marked or that you didn't tell us about. Nothing in these terms limits liability that can't be limited under Minnesota law.
Using this website

Resolving a disagreement
If you have a problem with our work or a bill, please call us first at (218) 514-2182. Most issues get settled with a conversation and a visit to the site, and we'd rather fix it than argue about it.
If we can't settle it that way, both sides agree to try good-faith mediation before going to court, unless the claim fits in small claims court. Any court case will be brought in the state or county courts that serve St. Louis County, Minnesota.
Governing law
These terms and any work we do are governed by the laws of the State of Minnesota, without regard to rules that would apply another state's law. This applies even when the job is at a property outside Minnesota, unless the law where the property sits requires otherwise.
Changes to these terms
We may update these terms from time to time. The version posted on this page is the one in effect. Changes don't affect a job already under a signed estimate or contract unless you agree to them.
